PVC MACT and TSCA on the Move at the EPA

The U.S. Environmental Protection Agency (EPA) agreed to reconsider emissions limits of the PVC MACT industry regulation in September 2012. The EPA has begun to review data and other materials provided by VI members and anticipates issuing a notice or proposed rulemaking on the Reconsideration Petition for the PVC rule by the end of 2019. This will be seven years after the Agency first agreed to reconsider the rule, and VI resin producer members look forward to EPA completing the reconsidered rulemaking.

Also, in accordance with the Toxic Substance Control Act (TSCA), as amended by the Lautenberg Chemical Safety for the 21st Century Act, the EPA has proposed 20 additional substances be prioritized for risk assessment next year. Ethylene dichloride (EDC), the precursor chemical for vinyl chloride monomer (VCM) was included in the prioritization proposal. VI provided up to date information on EDC to the Agency’s docket on June 19. 2019 so their scoping document for risk assessment is accurate.

The VI will continue to work with the EPA on both priority issues to ensure it has accurate information from the PVC industry.
